1. Introduction and Acceptance of Terms

These Terms and Conditions ("Terms") are a legally binding agreement between you ("User", "you", or "your") and the Buzzio Team ("we", "us", or "our") — currently an unincorporated operator of the Buzzio mobile application and related services ("App", "Buzzio", or "Service"). We may assign these Terms to a future registered legal entity; we will update this section with that entity’s legal name and address when that happens.

By downloading, installing, accessing, or using Buzzio, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, stop using the App and delete it from your device.

1.1 Changes to these Terms

We may update these Terms at any time. The Last Updated date will change. For material changes, we will provide in-app notice when appropriate. Continued use after the effective date of updated Terms means you accept them, except where mandatory consumer law requires a different acceptance method. Review them periodically at https://buzzio.dev or in the App.

2. Eligibility

• You must be at least 13 years of age to use Buzzio.
• If you are under 18 (or the age of legal majority where you live), a parent or legal guardian must review and agree to these Terms on your behalf.
• We do not knowingly collect personal information from children under 13. If we learn a user is under 13, we will terminate the account.
• The optional Bitcoin wallet requires you to be at least 18 years of age (or older if required by local law).

3. What Buzzio Is (Platform Nature)

Buzzio is a communications platform.
We provide tools that let people message, call, publish, and participate in groups, communities, broadcasts, Whisper sessions, Stories, and related features.

3.1 We provide tools — you control your conduct

Buzzio offers:

• Block — to stop unwanted contact
• Report — to flag abuse for possible review
• Privacy and safety controls (Secure View, vanish / disappearing modes, once-view, screenshot protection, passwords, roles, admins, and more as described below)

These tools help users protect themselves. They do not make Buzzio a guarantor of other people’s behavior.

3.2 User misconduct — our role and limits

Because Buzzio is a private, user-driven platform (and because many private surfaces are end-to-end encrypted so we cannot read message content), you acknowledge and agree that:

• We do not proactively police, monitor, or pre-screen private conversations.
• If other users engage in scams, fraud, harassment, impersonation, spam, phishing, pornography, nudity, sexual content, exploitation, threats, violence, or any illegal activity, those acts are the sole responsibility of the users who commit them.
• Buzzio is not responsible for other users’ conduct that we cannot reasonably prevent or detect.
• Your remedies against other users are primarily between you and them (and, where appropriate, law enforcement). Buzzio’s role is limited to providing the platform and, where technically possible and at our discretion, reviewing reports and applying enforcement actions described in these Terms.
• Nothing in these Terms limits liability or duties that cannot be excluded under mandatory law (including consumer protection and criminal law reporting duties where they apply).
• Using Buzzio is at your own risk. Do not send money, secrets, or intimate media to people you do not trust.

3.3 We do not sell your data

We do not sell your data. We never have. We never will.
This applies across every Buzzio feature described in these Terms and in the Privacy Policy.

4. Description of Service & Feature Overview

Buzzio may include some or all of the following features (availability can depend on region, device, plan, or product updates):

Details of data handling are in the Privacy Policy. The sections below set the rules and legal terms for using each surface.

5. Privacy Architecture (Accurate Scope)

5.1 Where “zero metadata” applies

“Zero metadata” is not a blanket claim for every Buzzio feature.
It applies specifically to these private surfaces:

1. 1-to-1 chat
2. Whisper private chat
3. End-to-end groups (for message archives / conversation transcripts of content)
4. Private calls (no durable server call history/recordings)

On those surfaces, after delivery or session expiry as designed, Buzzio does not keep a durable readable private conversation archive of who you talked to / what was said / call recordings — beyond transient delivery needs and the limited account, safety, and feature data described in the Privacy Policy.

5.2 Where more storage exists by design

Community, Broadcast, Stories, Whisper Questions, open-history groups, blocks, reports, optional pins, optional contact sync, optional cloud backup, and similar features store more so those products can work. Those differences are described below and in the Privacy Policy.

Even then, we do not sell that data. Never.

6. One-to-One Chat

6.1 How it works

• Messages are end-to-end encrypted on your device before they leave it.
• Our servers act as a blind relay for encrypted traffic.
• After delivery, encrypted copies are removed from the relay. Undelivered pending traffic is safety-purged on a short schedule (about 3 days).
• Readable history is stored in private device storage (locally encrypted database) on your device.

6.2 Zero metadata after delivery

If there are no undelivered messages left for a conversation on our relay, we do not retain a server-side record of who you are talking to for that chat.

6.3 Privacy & safety controls in 1-to-1 chat

You may use (where available):

Even with encryption and safety tools, you are responsible for who you talk to and what you share.
Buzzio is not responsible if another user scams you, harasses you, shares illegal or sexual content, or otherwise violates the law or these Terms in a private chat we cannot read.

We do not sell 1-to-1 chat data. Never.

7. Whisper Private Chat

• Whisper private chat is end-to-end encrypted.
• It is a zero-metadata conversation surface for durable private chat archives after the session ends.
• Sessions are time-limited; after expiry, associated session data is deleted from our servers.
• Optional vanish / screenshot restrictions may apply.

We do not sell Whisper private chat data. Never.

Buzzio is not responsible for misconduct by participants inside a Whisper private session.

8. Whisper Questions

• Whisper Questions is separate from Whisper private chat.
• It stores question/answer content so the link owner can receive answers (not the same E2E model as Whisper private).
• Limited abuse-prevention data (such as salted IP hashes / rate limits) and ownership/expiry data may be stored.
• Free links and Link Pack links expire on product schedules (for example about 24 hours free / 15 days Link Pack).

We do not sell Whisper Questions data. Never.

Owners and answerers remain responsible for content they post. Buzzio is not responsible for illegal, sexual, fraudulent, or abusive answers submitted by users.

9. End-to-End Groups

9.1 Encryption & metadata

• Message bodies in E2E groups are end-to-end encrypted.
• Encrypted delivery traffic is retained briefly (about 5 days for E2E group buckets), then purged.
• We do not keep a durable readable transcript of E2E group message content.
• Membership and roles are administration data needed to run the group.

9.2 Group controls

We do not sell E2E group data. Never.

Group members and admins are responsible for content and invitations they allow. Buzzio is not responsible for scams, illegal content, or abuse that members share inside groups.

10. Open-History Groups

• Open-history groups use server-held encryption keys so history and media-pool features can work for members (including later joiners).
• This is not the same as end-to-end groups.
• Longer retention (for example about 365 days by default) and media-pool limits/boosts may apply.

We do not sell open-history group data. Never.

11. Private Calls (Voice & Video)

• Call signaling is encrypted for setup.
• Call media uses peer-to-peer WebRTC whenever possible.
• We do not record calls and do not keep a durable server-side call history/recording archive.
• Call history shown in the app is stored locally on your device.
• We treat private calls as a zero durable call-metadata archive surface.

We do not sell call data. Never.

Buzzio is not responsible for what callers say or do on a call.

12. Broadcast Channels

12.1 Public vs unpublic

• At creation, use the public / discoverable toggle.
• Public (ON): discoverable so people can find and follow the channel.
• Unpublic / not public (OFF): not openly listed for everyone; access follows how the channel is shared and followed.

12.2 Who can message

• Admins post to the channel.
• Followers receive posts and may react as allowed.
• Followers do not get unrestricted posting unless product permissions say otherwise.

12.3 Retention & reactions

• Broadcast messages are deleted from our servers after about 30 days.
• Users may react to messages; reaction integrity data may be stored so the feature works.

We do not sell broadcast data. Never.

Channel admins are responsible for what they publish. Buzzio is not responsible for scam, illegal, or sexual content posted by channel operators or users.

13. Communities

13.1 How community messages are stored

• Communities use server-held encryption keys (DEK) so durable history, roles, and moderation can work.
• This is not end-to-end encryption like 1-to-1 chat.
• Default history retention is longer (about 365 days), subject to plan / media-pool limits.

13.2 What people can do

• Send text, video, image, GIF, sticker, and other permitted media types
• React to messages
• Delete messages where permissions allow (including delete-for-everyone style controls where supported)
• Create roles and appoint administrators / privileged roles
• Use channel controls such as password, vanish, and screenshot protection where available

13.3 Community metadata (honest)

Because communities are shared durable spaces, Buzzio may store membership, roles, messages/media, reactions, bans, invites, audit-style moderation logs, and storage usage — as needed to operate the community.

This is more metadata than private 1-to-1 E2E chat by design.
We still do not sell community data. Never.

13.4 Community responsibility

Community owners, admins, and members are responsible for content and moderation inside their community.
Buzzio is not responsible for scams, pornography, nudity, illegal activity, or other violations that users post in communities. We may act on reports at our discretion, but we are not a guarantor of community safety.

14. Stories, Profile, Sync & Backup

• Stories are short-lived (about 24 hours) and subject to audience/privacy settings.
• Profile / username / presence / achievements may store fields you choose to set, with privacy controls.
• Optional contact sync stores a contact set on your account only if you enable it.
• Optional encrypted cloud backup stores encrypted backup blobs if you purchase/enable it; recovery depends on keys you control.

We do not sell this data. Never.

15. User Accounts

15.1 Account creation

To use Buzzio you create an account identified by a Buzzio ID (a randomly generated 12-digit identifier). You control a mnemonic recovery phrase and private keys on your device. You are responsible for all activity under your account.

15.2 Account security

Safeguard your device, mnemonic, and credentials. Buzzio is not liable for loss caused by your failure to secure them. Loss of the mnemonic can mean permanent loss of private keys, local history access, and (if activated) wallet funds.

15.3 Account deletion

You may delete your account in-app or request deletion at app449377@gmail.com. Deletion removes associated account data we control, subject to legal retention needs and the Privacy Policy.

16. User-Generated Content

16.1 Ownership

You retain ownership of content you create or share ("User Content"). Buzzio does not claim ownership of your User Content.

16.2 License needed to operate the Service

Where a feature requires server storage (for example Community, Broadcast, Stories, Whisper Questions, open-history groups, reports, or backup), you grant Buzzio a limited, non-exclusive license to store, transmit, encrypt/decrypt as designed for that feature, display, and delete that content solely to operate the Service — not to sell it.

16.3 Your warranties

You warrant that your User Content does not:

• Violate any law or regulation
• Infringe intellectual property or privacy rights
• Contain illegal, harmful, threatening, abusive, harassing, or defamatory material
• Contain pornography, non-consensual intimate imagery, sexual exploitation, or unlawful nudity
• Exploit or harm minors in any way
• Promote violence, terrorism, scams, fraud, or other illegal activity
• Contain malware or harmful code

16.4 No proactive monitoring of private E2E content

Due to privacy-first design, Buzzio does not proactively read end-to-end encrypted private chats, Whisper private sessions, E2E group messages, or private call media.
We are not responsible for User Content we cannot access, and we are not responsible for illegal or harmful conduct occurring in those private surfaces that we cannot reasonably detect.

17. Prohibited Conduct

You agree not to:

• Use Buzzio for any illegal purpose
• Scam, defraud, phish, or socially engineer other users
• Harass, abuse, threaten, stalk, or intimidate others
• Share or solicit pornography, sexual content involving minors, non-consensual intimate images, or illegal sexual material
• Expose or distribute nudity or intimate media without lawful consent, or in violation of applicable law
• Spam or send unsolicited bulk messages
• Impersonate any person or entity
• Attempt unauthorized access to accounts, systems, or other users’ data
• Reverse engineer, decompile, or circumvent security controls (except where mandatory law allows)
• Distribute malware
• Use automated bots/scripts to abuse the Service
• Use the Bitcoin wallet for money laundering, sanctions evasion, fraud, or illegal finance
• Commercially exploit Buzzio without written consent
• Use production builds on rooted, jailbroken, compromised, or unsupported emulator environments where prohibited

17.1 Modified devices

Buzzio is not supported on rooted, jailbroken, or otherwise compromised devices. We may block or terminate access without notice to protect security.

18. Reporting, Blocking & Enforcement

18.1 Your safety tools

Buzzio provides block and report so you can reduce harm. Use them.
Blocking and reporting do not make Buzzio liable for another user’s prior or ongoing misconduct.

18.2 Reports

• You may report users for Terms violations.
• For relevant report types, we may review limited evidence you submit (for example the last 5 messages from a reported conversation on your device).
• On server-visible surfaces (Community, Broadcast, Whisper Questions, etc.), we may review stored content still within retention.

18.3 Enforcement (at our discretion)

If we believe a violation occurred, we may, without prior notice where reasonably necessary:

• Warn the user
• Limit features
• Temporarily suspend or permanently ban the account
• Remove content where technically available
• Report illegal activity to law enforcement

18.4 No guarantee of outcomes

• We are under no obligation to act on every report.
• Enforcement decisions are generally final for platform access; where mandatory law requires a review or appeal process, that law prevails. You may email app449377@gmail.com to request reconsideration of a ban or suspension.
• Buzzio does not guarantee that scams, pornographic content, nudity, illegal activity, or other violations will be prevented or removed.
• If people still commit scams, violations, expose nudity, or engage in illegal activities despite block/report tools, Buzzio is not responsible for that conduct beyond the limited role described in these Terms.

19. Subscriptions, Premium & In-App Purchases

19.1 Plans & items

Buzzio may offer:

• Buzzio Premium (for example monthly / yearly auto-renewing plans)
• Other in-app purchases (for example Whisper Questions Link Packs, boosts, backup plans, or media-pool related purchases)

Price, duration, and what you get are shown in the App and/or store listing before you confirm purchase.

19.2 Payment processing

Payments are processed by Google Play and/or the Apple App Store. Their terms and refund policies apply. Buzzio does not directly process card payments.

19.3 Auto-renewal & cancellation

• Subscriptions automatically renew unless you cancel according to the store’s rules (typically at least 24 hours before the next renewal).
• Android: manage or cancel in Google Play → Payments & subscriptions → Subscriptions.
• iOS: manage or cancel in Settings → [Your Name] → Subscriptions (or App Store account subscriptions).
• Canceling stops future renewals; you generally keep access until the end of the paid period already purchased.

19.4 Refunds & price changes

Refunds are handled by Google Play or Apple under their policies. We may change prices; changes usually apply at the next renewal period and will be shown by the store where required.

19.5 Consumer cooling-off (EEA / UK and similar)

Where mandatory consumer law gives you a right of withdrawal for digital content/services, that right applies as required by law (and may be limited once digital content has been fully provided with your prior consent and acknowledgment). Store refund rules may also apply.

We do not sell payment or subscription data. Never.

20. Bitcoin Wallet (Optional)

20.1 Opt-in only

No wallet is created at signup. Activation requires your explicit action and recovery-phrase verification.

20.2 Non-custodial

Buzzio is not a bank, exchange, broker, custodian, or money transmitter. We never hold your Bitcoin, private keys, or recovery phrase.

20.3 Same phrase, separate keys — critical risk

The wallet may use the same 12-word recovery phrase as messaging identity, with Bitcoin keys on a separate BIP-84 path. Messaging encryption keys are not reused for Bitcoin.

If someone obtains your recovery phrase, they may control both your Buzzio messaging identity and your Bitcoin.
If you lose the phrase, we cannot recover your funds.
Mainnet Bitcoin transactions are irreversible. Activate the wallet only if you understand these risks.

20.4 Your responsibilities

You alone are responsible for backing up the phrase, verifying addresses/amounts, irreversible mainnet transactions, taxes/sanctions compliance, and device security.

20.5 Mutual contact address sharing

If activated, your public receive address may be visible to mutual contacts who also enabled the wallet, solely to send Bitcoin between contacts.

20.6 Third-party blockchain services

Balances/broadcasts may use public APIs (for example Blockstream Esplora). Fiat estimates may use feeds (for example CoinGecko). We do not control Bitcoin or those providers.

20.7 No financial advice / no wallet warranty

Buzzio provides no investment, tax, or legal advice.
THE WALLET IS PROVIDED “AS IS.” We do not guarantee sync, fees, broadcasts, or protection against user error or third-party failures.

21. Intellectual Property

The App’s design, code, features, logos, trademarks, and related IP belong to us. These Terms give you no right to use Buzzio branding except as needed to use the App.
You may not copy, modify, distribute, sell, lease, or create derivative works of the App without prior written consent (except where mandatory law allows).

22. Copyright / DMCA-style complaints

If you believe content on Buzzio (for example Community, Broadcast, Stories, or Whisper Questions) infringes your copyright:

1. Email app449377@gmail.com with subject Copyright Complaint.
2. Include: your contact details; a description of the copyrighted work; the location/URL or enough detail to find the material; a statement that you have a good-faith belief the use is not authorized; a statement under penalty of perjury that the information is accurate and that you are the owner or authorized agent; and your signature (typed is acceptable).

We may remove or disable access to material and, where appropriate, terminate repeat infringers’ accounts. This process is intended to support US DMCA-style notices and similar laws elsewhere.

23. Third-Party Services

Buzzio may use third parties such as:

• Firebase / Google services (including Analytics)
• Cloudflare (for example R2 / Workers / history APIs)
• Bunny storage/CDN
• Google Play / Apple App Store
• GIPHY (GIFs/stickers)
• Blockchain and price APIs for the optional wallet

Your use may also be subject to those providers’ terms. We are not responsible for third-party practices, outages, or content.

We do not sell your data through third parties. Never.

24. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND (EXPRESS, IMPLIED, OR STATUTORY), TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We specifically disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted/error-free/secure operation, and accuracy of any content.

YOU USE BUZZIO ENTIRELY AT YOUR OWN RISK.
We do not warrant that privacy features are impenetrable, that others will behave lawfully, or that block/report tools will prevent harm.
We do not warrant wallet/blockchain security or availability.

Some jurisdictions do not allow certain warranty exclusions. In those places, exclusions apply only to the maximum extent permitted.

25. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

25.1 Exclusion of damages

IN NO EVENT SHALL WE BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or opportunities
• Cost of substitute services
• Unauthorized access to or alteration of communications
• Any User Content or conduct of any third party, including scams, fraud, harassment, pornography, nudity, sexual content, threats, or illegal activity
• Service interruption, suspension, or termination
• Loss of Bitcoin or digital assets (lost phrases, wrong addresses, device compromise, network/API failures)

— regardless of legal theory, even if advised of the possibility of such damages.

25.2 Maximum liability cap

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR TEN US DOLLARS (USD $10.00), WHICHEVER IS GREATER.

25.3 Essential purpose

These limits apply even if any limited remedy fails of its essential purpose.

25.4 Platform acknowledgment

YOU EXPRESSLY ACKNOWLEDGE THAT BUZZIO IS A PLATFORM FOR COMMUNICATION.
We provide block and report tools. If users still commit scams, Terms violations, expose nudity, share pornography, or engage in illegal activities, Buzzio is not liable for that conduct except where liability cannot be excluded by law.

25.5 Mandatory consumer protections

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under the laws of your country of residence (including certain EU/UK consumer rights).

26. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless the Buzzio Team and affiliates, officers, agents, and employees from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of:

• Your use or misuse of the App
• Your User Content
• Your violation of these Terms or any law
• Any dispute between you and another user
• Any claim that your User Content harmed a third party
• Your negligent or wrongful conduct
• Your use of the Bitcoin wallet

This obligation survives termination.
If you are a consumer in a jurisdiction that restricts indemnities, this section applies only to the extent allowed.

27. Dispute Resolution and Arbitration

27.1 Informal resolution first

Before arbitration or court action, email app449377@gmail.com describing the claim and relief sought. Both sides will try informal resolution for at least 30 days.

27.2 Binding arbitration (where allowed)

Subject to §27.5, any dispute arising out of these Terms or the App shall be resolved through binding individual arbitration, except claims that qualify for small claims court.

27.3 Class action waiver (where allowed)

Subject to §27.5, you and we may bring claims only in an individual capacity — not as a class, consolidated, or representative action — to the extent such a waiver is enforceable where you live.

27.4 Procedure

• Governed by arbitration laws of Sri Lanka
• Seat: Sri Lanka
• Language: English
• Decision final and binding; judgment may be entered in any court of competent jurisdiction

27.5 Consumer and mandatory-law carve-out

If you are a consumer and the laws of your country of residence (including EEA/UK consumer law) give you the right to bring proceedings in your local courts, or make arbitration / class-waiver clauses unenforceable, those mandatory rights prevail. In that case, disputes may be brought in the courts of your habitual residence (or other forum required by law), and §§27.2–27.4 apply only to the extent permitted.

28. Governing Law

These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka, without regard to conflict-of-law principles, except that mandatory consumer protection laws of your country of residence may still apply and take precedence where required.

29. Termination

29.1 By you

Delete your account and uninstall the App at any time.

29.2 By us

We may suspend or terminate access immediately, without prior notice, for any reason including Terms breach, legal risk, or platform abuse.

29.3 Effect

Your right to use Buzzio ends immediately. Surviving sections include Limitation of Liability, Indemnification, Dispute Resolution, Governing Law, and any other clauses that by nature should survive.

30. Severability

If any provision is unenforceable, it will be limited to the minimum extent necessary; the rest remains in force.

31. Entire Agreement

These Terms and the Privacy Policy are the entire agreement between you and us regarding Buzzio and supersede prior agreements on the same subject.

32. No Waiver

Failure to enforce any provision is not a waiver. Waivers must be in writing and signed by us.

33. Assignment

You may not assign these Terms without our prior written consent. We may assign them without restriction (including to a future registered entity).

34. Force Majeure

We are not liable for failure or delay caused by events beyond reasonable control, including natural disasters, war, terrorism, cyberattacks, government actions, or third-party outages.

36. Acknowledgment

BY USING BUZZIO, YOU ACKNOWLEDGE THAT:

1. You have read and agree to these Terms and the Privacy Policy.
2. You are at least 13 (and 18+ for the wallet).
3. Buzzio is a communications platform with block and report tools.
4. Buzzio is not responsible for other users’ scams, abuse, illegal acts, or sexual content beyond the limited role in these Terms, except where liability cannot be excluded by law.
5. Zero metadata applies specifically to 1-to-1 chat, Whisper private chat, end-to-end groups, and private calls, as described above — not to every product surface.
6. Buzzio does not sell your data — never.

37. Summary

• Platform: Buzzio provides communication tools; users are responsible for their own conduct.
• Safety tools: Block & report exist; they do not make us liable for other users.
• Age: 13+ app / 18+ wallet.
• Subscriptions: Auto-renew via Google Play or Apple; cancel in store settings (≥24h before renewal).
• 1-to-1: E2E; delete after delivery; no who-you-talk-to record when nothing undelivered remains.
• Whisper private: E2E; zero-metadata conversation surface; deleted after expiry.
• Whisper Questions: separate model; limited metadata; not sold.
• E2E groups / Community / Broadcast / Calls: as described above.
• Disputes: informal notice → arbitration in Sri Lanka where allowed; consumer mandatory rights preserved.
• Everywhere: we do not sell your data, and we never will.
